Application for Redevelopment Waiver and Qualitative Control Waiver and Quantitative Control Waiver

The City of Baltimore Department of Public Works is accepting public review and comments on this project’s application for a redevelopment and qualitative control waivers.

Project Description:

Proposed utility and roadway relocations and bridge replacement include civil and structural work to support the construction of Amtrak’s Frederick Douglass Tunnel.

The project work is located from the intersection of W. Mulberry Street and N. Warwick Avenue to the intersection of W. Mulberry Street and N. Smallwood Street and along the Amtrak’s Northeast Corridor where Amtrak’s undergrade bridge crosses over W. Mulberry Street; and in the median of the Franklin-Mulberry Expressway (US 40) between North Fulton Avenue and North Mount Street.

The project will consist of various utility relocations of both wet and dry utilities and roadway re-profiling with reconstruction of sidewalk and curb/gutter, retaining wall construction and substructure construction of the proposed Amtrak undergrade bridge over W. Mulberry Street along the Amtrak Northeast Corridor. The Applicant is requesting a qualitative control waiver in accordance with Article 7, Division II, §23-2 of the City Code. The Applicant has demonstrated that the 0.32 ac of the project will return the disturbed area to a predevelopment runoff condition. The applicant will not be required to provide qualitative control controls for 0.32 ac of this project.

The Applicant is requesting a redevelopment waiver in accordance with Article 7, §23-7 of the City Code. The existing impervious area coverage meets the conditions for this waiver. The project will provide impervious area reduction to satisfy the requirements of this waiver for 0.02 ac of this project. The Applicant will satisfy the remaining water quality controls for this project by payment of fee-in-lieu of on-site stormwater management for 1.01 ac of this project.

The Applicant is requesting a qualitative control waiver in accordance with Article 7, Division II, §23-2 of the City Code. The Applicant has demonstrated that the 0.32 ac of the project will return the disturbed area to a predevelopment runoff condition. The applicant will not be required to provide qualitative control controls for 0.32 ac of this project. 

The Applicant is requesting a Quantitative Control Wavier in accordance with Article 7, §23-1 of the City Code. The Applicant has demonstrated that on-site water quantity control for 0.09 ac of this project is not practicable. The Applicant will satisfy the water quantity control for this project by payment of fee-in-lieu of on-site stormwater management for 0.09 ac of this project.
