Application for Redevelopment Waiver, Qualitative Control Waiver, Quantitative Control Waiver and Recharge Variance
The City of Baltimore Department of Public Works is accepting public review and comments on this project’s application for redevelopment waiver, qualitative control, quantitative control waiver and recharge variance.

Project Description: | The project has an approximate area of 2.28 acres and is located at the intersection of Rutland Avenue and E. Biddle Street. The project will consist of 54 townhomes with associated driveways and utilities, three public alleys and landscaping. The Applicant is requesting a redevelopment waiver in accordance with Article 7, §23-7 of the City Code. The existing impervious area coverage meets the conditions for this waiver. The project will provide payment fee-in-lieu to satisfy the requirements of this waiver for 0.58 ac. of this project. The Applicant is requesting a qualitative control waiver in accordance with Article 7, Division II, §23-2 of the City Code. The Applicant has demonstrated that the 0.34 acres of the project will return the disturbed area to a predevelopment runoff condition. The applicant will not be required to provide qualitative control controls for 0.34 acres of this project. The Applicant has demonstrated that on-site water quality control is not practicable. The Applicant will satisfy the water quality controls for this project by payment of fee-in-lieu of on-site stormwater management for 0.34 acres of this project. The Applicant has demonstrated that 0.34 acres of the project directly discharges to a public storm system that can accommodate the anticipated stormwater flows from the project site without downstream flooding or stream-bank erosion. The Applicant has demonstrated that on-site water quantity control for [0.34 ac of] this project is not practicable.The Applicant will satisfy the quantitative controls requirements for this project by payment of fee-in-lieu of on-site stormwater management for 0.34 acres of this project. The Applicant is requesting a variance in accordance with Article 7, Division II, §23-4 of the City Code for this project’s recharge provisions. The recharge volume cannot be provided due to proximity to proposed buildings and roadways, and infeasibility of ESD and structural BMP since SWM outfall is unable to connect into the storm drain tunnel within Rutland Avenue.
